Community Infrastructure Levy & S106

 

In some cases, the council has the power to require developers to provide public benefits, including financial contributions. The legal mechanism for securing the provision of these benefits is a legal document (a deed) made pursuant to section 106 of the Town & Country Planning Act 1990, known as a s106 planning obligation (where only the developer needs to sign it) or a s106 planning agreement (where all parties sign).
 
Either way, these contributions need to be justified in accordance with the council’s planning policy.
 
We can advise on the need to make the contribution, negotiate with the Council if necessary, & draft the s106.
