Community Infrastructure Levy & S106

 

S106 obligations may be made by agreement, or may be submitted unilaterally by a developer.

We are experienced in drafting these documents & currently do so for local authorities. We are happy to discuss with local authorities the provision of our services in this respect.

 

Our current (& best) practice is that prior to commencing any work we will secure from the developer an undertaking to pay our legal costs, whether or not the s106 is completed. We will invoice the developer direct for these costs when our work is complete. Therefore, the LPA does not need to be involved in either the administration or payment of costs.
