Party Wall Act 1996

The Party Wall Act 1996 came into force in 1997. It affects both Building Owners (person wishing to commence building works) & Adjoining Owners (person whose property may be affected by the proposed works).
The Act provides a legal mechanism by which a Building Owner may carry out works within the scope of the Act, whilst affording protection & rights to the Adjoining Owner.
In a nutshell, the Party Wall Act comes into play when a Building Owner proposes to build up to or astride a boundary or if the Building Owner proposes to lay foundations of a certain depth within three or six metres of a building on the Adjoining Owners land.
In such cases an Award is made detailing the proposed works. That Award can be appealed if necessary.
