This course is designed for all officers involved in the development control process. Depending on the experience of each team member, it will constitute either a complete learning experience, or a reminder & consolidation process.

' Development: operational development; material change of use
' Lawful Development: LDC applications; issue of certificates; recognising limitations; appeals
' Permitted Development: GPDO; Article 4 Directions

' Planning Permission: S54A; material considerations; reasons for refusal (& grant)
' Conditions: power to impose; tests in Circular 11/95; PD conditions
' S 106 Obligations: when to use; agreement v unilateral; enforcement of
' Appeals: types; basic rules

' Breaches of Planning Control
' Requisitions for Information - PCNs; s330; s16
' Enforcement Notices - expediency, content, service, appeal, breach, direct action; practical exercise - drafting
' Breach of Condition Notices: when to use; content; service; breach

' Stop Notices: power to issue; content; service; compensation; temporary stop notices
' Injunctions: s187B; when to seek
' Untidy Land: s215 Notice - content, service, non-compliance; direct action

' Advertisement Control - need for consent; exempt adverts; deemed consent; prosecutions
' Protection of Trees: conditions; TPOs, prosecutions
' Listed buildings & Conservations Areas: need for consent; alteration v demolition; LBENs

' Prosecutions & Evidence: When to prosecute; CPS tests; evidential requirements
' Witness Statements: making & taking; formalities; content; hearsay; practical exercise
' Dealing with Suspects (PACE): the need to caution; interviewing under caution; on site meetings; contemporaneous notes; telephone interviews; interviews by letter; taped interviewing; practical exercise

 

Cost:

£870 per session for up to 20 officers

 

Total £5,220 for all 6 sessions

 

Includes power point presentation & presentation folder for each delegate.
